Terms of Service
Effective date: 10 July 2026 · Garg Foamtech Private Limited ("Foamtech", "we", "us")
These terms govern your use of foamtech.in and, unless superseded by a signed agreement or our formal quotation terms, the supply of products by Garg Foamtech Private Limited, E 926 Phase III, RIICO Industrial Area, Bhiwadi, Rajasthan 301019, India.
1. Website use
Content on this website is provided for general information about our products and capabilities. You may not copy, scrape or reuse site content, images or branding for commercial purposes without our written permission.
2. Quotations and estimates
- Quotes and the on-site savings calculator provide indicative figures only. Savings depend on your products, volumes and current packaging.
- Written quotations are valid for the period stated on them (typically 7–15 days) and are subject to raw-material price movements.
- Product specifications (dimensions, density, thickness, bubble size) are confirmed at order stage; standard manufacturing tolerances apply.
3. Orders, MOQ and samples
- Minimum order quantities vary by product and are stated on the relevant product page or quotation.
- Custom-designed items (die-cut fitments, printed material, custom profiles) are manufactured to your approved specification or sample and cannot be cancelled once production begins.
- Prototypes/samples are provided per the terms agreed for each request.
4. Prices, payment and GST
- All prices are exclusive of GST unless stated otherwise; GST invoices are issued for every order.
- New customers: payment in advance. Established customers may be offered credit terms (typically 30 days) at our discretion, in writing.
- Accepted modes: NEFT, RTGS, UPI and cheque. Delayed payments may attract interest as permitted under the MSMED Act, 2006.
5. Delivery and risk
- Dispatch timelines (e.g. same-day/next-day for standard sizes) are good-faith estimates, not guarantees, and depend on order volume and transport conditions.
- Unless agreed otherwise, risk in the goods passes on delivery to the carrier or to your premises as per the agreed Incoterm/delivery basis on the invoice.
- Please inspect goods on receipt and notify us of shortages or transit damage within 48 hours, with photographs.
6. Returns and claims
Manufacturing-defect claims are accepted within 7 days of delivery. Verified defective material will be replaced or credited at our option. Custom-manufactured items are non-returnable except for manufacturing defects.
7. Product suitability
Recommendations regarding cushioning, ESD protection or export compliance are made in good faith based on the information you provide. Final validation of packaging performance for your specific product and transit conditions is your responsibility; we are happy to support with trials and prototypes.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising from an order is limited to the invoice value of the goods concerned. We are not liable for indirect or consequential losses, including lost profits or business interruption.
9. Intellectual property
Packaging designs, dies and artwork developed by our R&D team remain our property unless expressly transferred in writing. Your logos and artwork supplied for printing remain yours; you confirm you have the right to use them.
10. Privacy
Information submitted through this website is handled per our Privacy Policy.
11. Governing law and jurisdiction
These terms are governed by the laws of India. Courts at Bhiwadi/Alwar, Rajasthan shall have exclusive jurisdiction, subject to any mandatory MSME dispute-resolution mechanisms.
12. Changes
We may update these terms from time to time; the current version will always be available at foamtech.in/terms-of-service.html.
